Civil law is the counterpart to criminal law in the British legal system. It relates to matters and disputes between individuals.
Unlike criminal law, it is up to the individual to enforce their rights under the civil law themselves. They can do this through private negotiation but if this fails, they may ask a court to enforce their rights through bringing a lawsuit.
We understand that dealing with a dispute, whether its large or small, can be a particularly stressful experience, especially if you are unsure about the costs and procedures involved, which is why we make every effort to reach fair and mutually beneficial settlement before seeking to resolve such disputes using court proceedings.
At Virgo Consultancy Services Ltd we regularly handle a wide range of disputes and we are able to provide practical and specialist advice with the aim of resolving your dispute quickly and cost-effectively.
What does civil law cover?
Civil law may be said to cover everything that is not part of criminal law. It is commonly broken down into different specialist fields, and even these fields may be broken down further. Major examples include:
- Property law
- Personal injury
- Professional negligence
- Partnership & employment disputes
- Contract and Consumer Problems
- Residential Landlord And Tenant Issues
- Debt Collection and Assistance
- Contentious Probate and Claims Under The Inheritance (Provision for Family and Dependants) Act
How does civil law operate?
Civil law provides the rules that people should obey when dealing with each other. It is designed to encourage people to deal fairly and reasonably at all times by allowing individuals to enforce their rights through the courts if they are infringed.
Both sides can bring evidence to support their position and the court will make a decision based upon it. If the parties do not want to go all the way to court, they can also opt to use alternative forms of dispute resolution, such as mediation or arbitration. The object of the law is always to try and find a fair and equitable solution to the problem.
Wherever possible, we always seek to settle disputes by negotiation. In many cases, disputes can be resolved by using alternative dispute resolution (ADR) methods such as mediation and arbitration. These procedures tend to be more informal and less adversarial than going to Court. Our Team of Solicitors and Advocates will work for you to reach a mutually satisfactory outcome to both parties but we do recognise that there are occasions however, when Court action is necessary. Rest assured that our Litigation Team will provide a robust and efficient presentation of your case in order to gain best result for you.
